Can somebody file head of household even if he is married and lives with his wife his wife didnt have any inc?

she is a nonresident alien with an itin number she lived with him all year but she did not have any income at all does he still needs to file as marriedCan somebody file head of household even if he is married and lives with his wife his wife didnt have any inc?
he cannot file head of household but they can file married filing jointly even if she did not have income or he can file married filing single however he can not file hoh idon't think but if he has dependants he probaly can i don't know.call irs at 1-800-829-1040 and ask them.Can somebody file head of household even if he is married and lives with his wife his wife didnt have any inc?
She's a resident alien for tax purposes because she lived here all year. A spouse is NEVER a dependent. You are married - you file either married joint or married separate regardless of her income.
If he can claim her as a dependant he can claim Head of household or if they have children, b ut if he cannot claim her he needs to file married - on turbo tax you can try it both ways to see which way it comes out better, but legally as long as they are legitamitly married and he can claim her it should be fine!
She is NOT a non-resident alien unless she is here on an F-1 or J-1 visa.





Living in the US ';all year'; generally meets the 183day substantial presence test.
